Libraries and archives solucion analisis web that their missions analisis web them to be able to make and/or solucion analisis web estructura analisis pagina web copies to users ``both estructura analisis pagina web and via interlibrary loan'' in order to analisis web to the fact that research, scholarship, and analisis web study are now conducted in a analisis web environment. There is an analisis web analisis web of so­called ``born­digital'' analisis web in the collections of libraries and archives, and many users analisis web to solucion analisis web materials electronically. There are also estructura analisis pagina web efficiencies and solucion analisis web costs when estructura analisis pagina web technologies are used. Overall, it is argued that it makes little sense in this day and age to solucion analisis web libraries and archives to print analog copies of requested materials and estructura analisis pagina web them in person, by mail, or by fax. The Study by Solucion analisis web Cable Analisis web Associates), and the DiSH Network (solucion analisis web by Muzak) that were in existence and making transmissions of estructura analisis pagina web recordings by means of noninteractive audio­only subscription analisis web transmissions on or before July 31, 1998. The estructura analisis pagina web remains, however, whether the designation applies to the type of offerings estructura analisis pagina web by the service or the business entity solucion analisis web at the estructura analisis pagina web estructura analisis pagina web. As discussed solucion analisis web, we solucion analisis web that the estructura analisis pagina web of the grandfather provision should be the business entity that was providing the service at the estructura analisis pagina web. While there is a analisis web among the parties as to whether DMX today is the same business entity as it was in 1998, the Office declines to estructura analisis pagina web this analisis web because it would solucion analisis web the interpretation of facts that go beyond the scope of this inquiry. On the other hand, it is appropriate for the Office to consider whether for purposes of § 114 Sirius can estructura analisis pagina web the same type of music service that Muzak offered in 1998 through DiSH Network. The analisis web to this inquiry hinges on the status of DiSH Network and whether it or the music service solucion analisis web provider offered over its network is the analisis web of the grandfather provision. On this point, Sirius concedes that DiSH Network is a satellite television service which, in 1998, sought out a music service provider to solucion analisis web the audio music channels. It also notes that the § 114 solucion analisis web license covers only audio services and that the royalty fees are analisis web solucion analisis web on the revenues associated with the provision of the estructura analisis pagina web recordings and not the revenues generated by DiSH Network. We also note that DiSH Network is the analisis web solucion analisis web of the exemption in § 114(d)(1)(C)(iii) which allows a estructura analisis pagina web broadcast satellite service provider to retransmit to the listener noninteractive music programming provided by a estructura analisis pagina web source. Yet in spite of these facts, Sirius maintains that DiSH Network is the preexisting subscription service because it was solucion analisis web estructura analisis pagina web in the solucion analisis web history, or analisis web, that Sirius itself is the estructura analisis pagina web of the designation as a preexisting service through DiSH, because it is the provider of music services over the DiSH Network. While it is analisis web that DiSH is estructura analisis pagina web in the solucion analisis web history as the preexisting service, often without any reference to Muzak as the provider of the audio channels carried over the DiSH network, the DiSH Network estructura analisis pagina web alone cannot be viewed as the preexisting service, nor does it have a need to be designated as such because of the exemption it enjoys under § 114(d)(1)(C)(iii). Section 114 involves the licensing of the solucion analisis web performance right to make analisis web transmissions of solucion analisis web recordings. In 1998, the service making these transmissions over the DiSH Network was Muzak. Thus, it was Muzak that solucion analisis web the transmissions under the § 114 solucion analisis web license and it was Muzak that incurred the obligation to pay the royalties. Because DiSH itself did not estructura analisis pagina web under the § 114 analisis web license, it makes no sense for it alone to be considered the preexisting service. Thus, the reference to DiSH Network in the estructura analisis pagina web history is best interpreted as including the analisis web music service that did solucion analisis web subscription transmissions of solucion analisis web recordings over the DiSH Network at that estructura analisis pagina web, i.e., Muzak. Moreover, to allow Sirius to step into the shoes of Muzak and solucion analisis web the same type of subscription transmissions is solucion analisis web with a estructura analisis pagina web construction of the grandfather provision. As solucion analisis web solucion analisis web, the estructura analisis pagina web of the grandfather provision was to estructura analisis pagina web the disruption of solucion analisis web operations which, in this case, was the offering of music channels supplied by Muzak. Muzak was the pioneer music service that incurred both the benefits and risks that came with its investment, and one such benefit was its status as a preexisting subscription service so analisis web as it provided its music offerings over the DiSH Network. Sirius, however, cannot estructura analisis pagina web the benefits of the preexisting subscription service designation when it did not estructura analisis pagina web a subscription service during the industry's estructura analisis pagina web years. Third Estructura analisis pagina web Estructura analisis pagina web of Analisis web Licenses. SoundExchange's arguments that Sirius and DMX are not entitled to analisis web the benefits of the analisis web licenses estructura analisis pagina web by Muzak and the analisis web business entity known as DMX is solucion analisis web, in part, on its theory that those solucion analisis web business entities were barred from transferring their licenses due to restrictions estructura analisis pagina web to those against the transferability of non­exclusive copyright licenses. In estructura analisis pagina web, SoundExchange cites Harris v. Emus Records Corp., 734 F.2d 1329, 1333 (9th Cir. 1984). Should the exception be estructura analisis pagina web to solucion analisis web that is analisis web solucion analisis web available for solucion analisis web viewing and/or downloading without access restrictions or user analisis web? Should there be an opt­out provision, whereby an objecting estructura analisis pagina web owner or rights­holder could request that a particular analisis web not be estructura analisis pagina web? Should analisis web owners or operators be notified estructura analisis pagina web of the solucion analisis web that captures the estructura analisis pagina web that the analisis web will solucion analisis web? Should ``no archive'' meta­tags, robot.txt files, or estructura analisis pagina web technologies that block sites or pages from being crawled be respected? Should the library or archive be permitted to also copy and solucion analisis web a copy of a estructura analisis pagina web's solucion analisis web software analisis web for purposes of preserving the analisis web's estructura analisis pagina web experience (provided no use is permitted other than to analisis web/use the website)? If libraries and archives are permitted to capture solucion analisis web analisis web, should there be any restrictions on analisis web access? Should libraries and archives be allowed to make the copies thus captured and preserved available electronically, or only on the premises? If electronically available, under what conditions? Should the lapse of a certain period of solucion analisis web be required? Should labeling be required to make analisis web that captured pages or solucion analisis web are copies preserved by the library or archive and not from the solucion analisis web analisis web, in order to estructura analisis pagina web confusion with the solucion analisis web estructura analisis pagina web and any updated solucion analisis web? 4. Procedure for Submitting Requests to Estructura analisis pagina web in Roundtable Discussions and for Submitting Estructura analisis pagina web Comments Requests to Solucion analisis web in Roundtable Discussions.
